1. Acceptance of these Terms
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using the Service, you represent and warrant that you meet these requirements and that your use complies with all laws that apply to you.
3. The Service
Rankingslets you build a list of almost anything — songs, movies, actors, foods, places, or any topic you choose — rate the items on a 1–10 spectrum, view and share the resulting rankings, and play real-time, room-based "bracket" voting games. Ratings and rankings are subjective opinions of users, provided for entertainment. They are not statements of fact by us and are not endorsements. We may add, change, suspend, or discontinue any part of the Service at any time without notice.
4. No accounts; links as access
The Service does not use accounts. Shared content is protected only by a short, unguessable code in its link, and live rooms by a room code. Anyone who has a link or code can access the associated content or room. You are responsible for deciding with whom you share links and codes. Do not use the Service to store anything you need to keep private, secure, or durably retained.
5. Your content
"User Content" means anything you submit to or create with the Service, including names, text, titles, images, and image URLs. You retain whatever rights you already hold in your User Content. You are solely responsible for your User Content and for the consequences of submitting or sharing it.
License you grant us
You grant WBX Digital a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit your User Content solely as needed to operate, provide, secure, and improve the Service (for example, storing a snapshot so a link you created can be opened). This license lasts as long as the relevant content remains on the Service and ends a reasonable time after it is deleted. You represent and warrant that you have all rights necessary to grant this license.
6. Content standards and acceptable use
You are solely responsible for your User Content. You agree not to submit, share, or use the Service to create content that:
- Is unlawful or infringing — illegal, fraudulent, defamatory, or obscene, or that infringes any copyright, trademark, privacy, publicity, or other right, or that includes non-consensual intimate imagery.
- Harasses or attacks people— harasses, bullies, threatens, defames, demeans, stalks, "doxes," or incites violence against any person, or attacks any individual or group on the basis of race, ethnicity, national origin, religion, disability, sex, gender, sexual orientation, age, or any other protected characteristic.
- Endangers minors — sexualizes, exploits, or depicts in a sexual manner anyone under 18. Any content that sexually exploits or endangers a minor is strictly prohibited and will be reported to the appropriate authorities.
- Misuses the Service — attempts to breach security, disrupt or overload the Service, scrape it at scale, upload malware, circumvent access controls, or otherwise use it in violation of these Terms or applicable law.
If your content includes real people.The Service can be used to rank real people (for example, a list of actors or athletes). If you submit a person's name, image, or other information, you represent that you have the legal right to do so and have obtained any consent required by law in your and their jurisdiction, and you are responsible for respecting their privacy, publicity, and image rights.
These standards are examples, not an exhaustive list. We may refuse, remove, or restrict any content or use we consider, in our sole discretion, to violate these Terms or to be otherwise objectionable.
7. Moderation, removal, and termination
We are not obligated to monitor User Content, but we may review, remove, or disable access to any content, and suspend or terminate your access to the Service, at any time and for any reason, including suspected violation of these Terms — with or without notice and without liability to you. We may also delete inactive or expired content as part of routine operations.
8. Our intellectual property
The Service itself — its software, design, branding, and content we provide (excluding User Content) — is owned by WBX Digital or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted.
9. Third-party content and links
The Service may display images loaded from third-party URLs supplied by users and may link to third-party sites. We do not control, endorse, or assume responsibility for any third-party content, sites, or services, and your use of them is at your own risk and subject to their terms.
10. Copyright complaints
If you believe content on the Service infringes your copyright, send a notice to contact@wbxdigital.com that includes: identification of the work; identification of the allegedly infringing material and its link or code; your contact information; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act; and your physical or electronic signature. We may remove allegedly infringing content and terminate repeat infringers.
11. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY CONTENT OR DATA WILL BE PRESERVED, AVAILABLE, ACCURATE, OR FREE OF OBJECTIONABLE MATERIAL. YOU USE THE SERVICE AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WBX DIGITAL AND ITS OWNERS, OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE AGREEMENT BETWEEN US.
13. Indemnification
You agree to indemnify, defend, and hold harmless WBX Digital and its owners, operators, affiliates, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.
14. Availability and data loss
We do not guarantee that the Service, any link, any room, or any content will remain available. Rooms are ephemeral, local data can be lost if you clear your browser, and shared snapshots may be removed at any time. You are responsible for keeping your own copies of anything important.
15. Governing law and disputes
These Terms are governed by the State of Ohio, United States, without regard to its conflict-of-laws rules. Before filing a claim, you agree to try to resolve the dispute informally by contacting us. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Ohio, United States, and you consent to personal jurisdiction there. To the extent permitted by law, you and WBX Digital each waive any right to a jury trial and agree that claims may be brought only in an individual capacity and not as part of any class or representative proceeding. Any claim must be brought within one (1) year after it arises, or it is permanently barred.
16. Changes to these Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the Service.
17. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and WBX Digital regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions stay in effect, and the unenforceable provision will be enforced to the maximum extent permitted. Our failure to enforce any right is not a waiver of it. You may not assign these Terms without our consent; we may assign them freely. Nothing in these Terms creates any agency, partnership, or employment relationship. Section headings are for convenience only.
